1. Company Information
These Terms and Conditions ("Terms") govern access to and use of shop.elartcom.eu ("Website") and the purchase of products offered by:
UAB Elart is incorporated and registered in the Republic of Lithuania and operates in accordance with applicable Lithuanian and European Union law.
2. Acceptance of Terms
By accessing the Website, creating an account, or submitting an order, you indicate your acceptance of these Terms. If you do not accept these Terms, you should not use the Website.
These Terms are published in English. Where any translation may exist, the English version shall prevail in the event of any inconsistency.
3. Customer Types — B2C and B2B
Natural persons purchasing for personal, non-commercial purposes. Entitled to all rights under applicable EU consumer protection legislation, including those in our Return & Refund Policy.
Legal entities or natural persons purchasing in the course of a trade, business, or profession. Statutory consumer rights — including the right of withdrawal — do not apply.
Note: Entry of a VAT number at checkout is taken as confirmation of business customer status.
4. Products and Catalogue
- Our catalogue includes a broad range of automotive spare parts and accessories. Availability is subject to change without notice.
- Product listings may include reference data (vehicle fitment, OEM numbers, cross-references) as a general guide only — not a guarantee of fitment.
- It is the customer's responsibility to verify that any part is suitable for their specific vehicle before ordering. We do not accept liability for parts purchased for an incorrect application.
- Product images are illustrative. Actual products may differ in minor respects from those depicted.
5. Pricing
- Prices are shown in the displayed currency and are inclusive of applicable VAT unless otherwise stated.
- The price applicable to your order is the price displayed at the time you submit your order.
- Delivery charges are shown separately at checkout prior to order confirmation.
- In the event of a manifest pricing error, we reserve the right to cancel the affected order and notify you promptly.
6. Ordering Process
- Orders may be placed via a registered account or guest checkout. Provide accurate, complete information.
- Adding products to your basket does not constitute a binding order or create stock reservation.
- By clicking "Confirm Order", you submit a binding offer to purchase.
- An order is accepted when we send you an Order Confirmation email. The contract is formed at that point.
- Where we cannot fulfil your order in whole or part, we will notify you and arrange a refund accordingly.
7. Payment
Full payment is required at the time of ordering, unless a separate credit arrangement has been agreed in writing.
Accepted payment methods: Visa, Mastercard, PayPal, EveryPay, Bank Transfer
Payments are processed securely through our payment service providers. We do not store full card details.
8. Delivery and Shipping
- Available shipping options and estimated delivery times are shown at checkout.
- Estimated timeframes are not guaranteed — actual delivery may be affected by carriers, customs, or force majeure.
- For consumers: risk passes on physical receipt (Article 20 of Directive 2011/83/EU). For business customers: risk passes on handover to carrier.
- Customs duties outside the EU are the sole responsibility of the recipient.
9. Right of Withdrawal
10. Warranty and Defective Goods
Consumer customers benefit from a 2-year statutory guarantee from delivery (EU Directive 2019/771). Defects within the first 12 months are presumed to have existed at delivery. See our Warranty page for full details.
Business customers: defect claims must be submitted in writing within 14 days of delivery. Liability is generally limited to replacement or repair of the confirmed defective item.
11. Limitation of Liability
To the fullest extent permitted by applicable law, UAB Elart's aggregate liability shall not exceed the total amount paid for the specific transaction. We do not accept liability for indirect, consequential, or economic losses, loss of profit, loss of data, or losses from incorrect part selection or installation.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other matter where liability cannot lawfully be excluded. Statutory rights of consumer customers are not affected.
12. Intellectual Property
All Website content — including text, images, logos, design elements, and software — is owned by UAB Elart or used under licence, and is protected by copyright and other intellectual property rights. No part may be copied or distributed without prior written consent, save as permitted by law.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Lithuania. Disputes should first be referred to our customer service team. Where a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the competent courts of Lithuania.
14. Changes to Terms
We reserve the right to amend these Terms. Any revised version will be published on this page with an updated effective date. Where changes are considered material, we endeavour to provide reasonable advance notice to registered customers. Continued use of the Website following publication of revised Terms constitutes acknowledgement of the updated version.
